Right of cancellation for consumers

Consumers is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession (Section 13 BGB).

Cancellation policy

Right of withdrawal

You have the right to cancel this contract within 14 days without giving any reason.

The cancellation period is 14 days from the date,

on which you or a third party named by you, who is not the carrier, have taken possession of the goods if you have ordered goods, or
on which you or a third party named by you, who is not the carrier, took possession of the last goods if you ordered several goods as part of a single order, or
on which you or a third party named by you, who is not the carrier, took possession of the last partial consignment or the last item, if the goods were delivered in several partial consignments or items.

To exercise the right to cancel, you must inform us (Julian Kirschler, c/o Postflex #5210, Emsdettener Straße 10, 48268 Greven, Germany, E-Mail: info@julian-kirschler.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. by e-mail or letter sent by post). You can use the sample cancellation form below, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the deadline expires.

Consequences of cancellation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from a different type of delivery than the standard delivery offered by us), immediately and at the latest within 14 days from the day on which we receive notification of your cancellation.

For the refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise. Under no circumstances will you be charged any fees for this refund.

We may refuse to refund you until we have received the goods back or you have provided proof that you have returned the goods - whichever is the earliest.

You must return or hand over the goods to us immediately and in any case within 14 days at the latest from the day on which you inform us of the cancellation. The deadline is met if you send the goods before the 14-day period has expired.

You bear the direct costs of returning the goods. For works of art that cannot be sent by parcel post (e.g. large framed formats), we will organise collection - the costs for this will be agreed individually as part of the cancellation process.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to check their condition, properties and functionality.

Exclusion or premature expiry of the right of cancellation

The right of cancellation does not apply to contracts for the delivery of goods,

which are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or
which are clearly tailored to the personal needs of the consumer.

This applies in particular to artworks produced to order, e.g. limited edition photo prints in certain formats or designs with customised framing.
