I. General Terms and Conditions
§ 1 Basic provisions
(1) The following business terms are applicable to all the contracts, which you conclude with us as a supplier (Julian Kirschler) via the www.julian-kirschler.com concludes. Deviating terms and conditions of the customer shall only apply if we have expressly agreed to their validity.
(2) A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
§ 2 Conclusion of the contract
(1) The presentation of the products in our online shop constitutes a binding offer to conclude a purchase contract.
(2) The contract is concluded via the integrated online shopping basket system. You place the desired products in the shopping basket, go through the electronic ordering process and at the end place a legally binding order by clicking on the correspondingly labelled button ("order with obligation to pay", "buy now" or similar).
(3) Before sending the order, you can check all details again and change them if necessary. The contract is concluded as soon as you send the order.
(4) After placing your order, you will receive an automatic confirmation by e-mail. This confirmation documents the receipt of your order, but does not constitute acceptance of the contract. Acceptance of the contract takes place by separate e-mail with confirmation of dispatch or delivery of the goods.
§ 3 Licence of use for digital content
If digital content is offered, you will receive a simple, non-transferable licence for use in accordance with the terms and conditions specified in the respective offer. All content is subject to copyright.
§ 4 Payment methods and terms of payment
(1) The available payment methods (e.g. PayPal, Klarna, Stripe, Amazon Pay) are listed in the order process and in the "Payment & Shipping" section.
(2) The respective terms and conditions and data protection guidelines of the selected payment service provider shall apply.
(3) Payment claims are due for payment immediately, unless otherwise stated in the order process.
§ 5 Retention of title
The goods remain our property until full payment has been received.
§ 6 Delivery & Shipping
(1) The delivery conditions, delivery times and shipping costs are listed on our website under "Payment & Shipping".
(2) For deliveries to non-EU countries, additional customs duties, taxes or fees may apply, which you as the buyer must bear.
§ 7 Right of cancellation
Consumers are generally entitled to a statutory right of cancellation. You can find the details in the Cancellation policy.
The right of cancellation may be excluded for custom-made or made-to-order works (e.g. signed, framed or limited edition photographic art), where permitted by law.
§ 8 Warranty
The statutory warranty rights apply.
Please check the goods immediately upon receipt. Please inform us promptly of any obvious defects - without this being a prerequisite for your rights.
§ 9 Dispute resolution / OS platform
The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/odr
We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
§ 10 Choice of law
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. In the case of consumers, this choice of law shall only apply insofar as the protection granted by the country of residence is not withdrawn by mandatory provisions.

The complete contract text is not saved permanently. Before sending the order, you can save the contract text using the print function of your browser. After receipt of your order, we will send you an order confirmation with all relevant data by e-mail.

The contract is concluded in accordance with § 2 of our General Terms and Conditions.

The essential characteristics of the goods are specified in the respective product description in the online shop.
5. prices and shipping costs
All prices are total prices including statutory VAT. Shipping costs are shown separately and are to be borne by the buyer, unless free shipping is offered.
Deliveries to countries outside the EU may incur additional costs (e.g. customs duties or fees), which you as the buyer are responsible for.
6. delivery
Delivery will be made to the address you specify, unless otherwise agreed. Further information can be found under "Payment & Shipping".
In the case of consumers, the risk is only transferred when the goods are handed over. In the case of entrepreneurs, the transfer of risk takes place upon handover to the shipping company.
